In the lawsuits filed it is alleged that hip implant is improperly designed causing the Depuy Hip Implant, specifically the ASR XL System or ASR Hip Resurfacing System to prematurely fail. WHAT IS THE STATUS OF THE LITIGATION?
In December 2010, the United States Judicial Panel on Multi-District Litigation (MDL) ruled to consolidate all federal district cases in the Northern District Court of Ohio. Judge David A. Katz will preside over and manage all pre-trial issues for all federal DePuy hip implant recall cases.
Multi-district litigation is simply a mechanism to preserve judicial resources and ensure uniformity of decision. To claimants it can be very helpful in resolving cases. However, at times it is cumbersome and slow moving. How the Depuy MDL moves is unknown.
